What happens in family court after I’ve applied? – Once the family court receives your C100 court application, it will send a ‘notice of hearing’ to both you and the respondent. This will contain information about the hearing’s date, time, and location. The respondent will also receive a copy of your application.
What happens next
If you live in England and Wales, the family court will forward your details to Cafcass or Cafcass Cymru. Their role is to provide impartial advice to the court concerning your children’s welfare, as they are involved in the family court proceedings. They will conduct safeguarding checks and examine the information provided by both parents about violence or abuse.
The Role of Cafcass in family court process
Cafcass will contact you and the other parent by phone to discuss issues related to your children’s safety. They they may enquire about the disagreements you have. During the first hearing, you will have the opportunity to discuss these matters.

The court will consider the results of the safeguarding checks conducted by Cafcass to determine what is best for your children. At this stage, Cafcass will not speak to your children as the court will decide how to involve them during the first hearing.
First Hearing
First Hearing and Dispute Resolution Appointment or FHDRA is the first hearing of the process. You may have to write a position statement for the first hearing. It may also be helpful to make notes about what you want to say at the court to prepare for the first hearing.
What Happens with children in family court
Unless your child is part of the court process, such as a witness or scheduled to meet with the judge, they should not generally attend court. If it is necessary to bring your child, please bring an adult friend or family member to care for them during the hearing, as court staff cannot do so.
